Marriage

Request for certificate of no impediment for Marriage before Vietnamese Authorities

Vietnamese authorities require Italian citizens intending to marry in Vietnam to obtain a certificate of no impediment to marriage (nulla osta), which will be issued by the Consular Office of the Embassy of Italy in Hanoi for nationals residing in Vietnam and registered with AIRE.

The nulla osta must then be translated and legalized according to local regulations in order to be legally valid under Vietnamese law.

For Italian citizens not registered with AIRE in the consular district of Hanoi, the nulla osta will be issued only upon presentation of the original certificate of civil status (certificato di stato libero), issued no more than 6 months prior by the competent Italian municipality or Italian diplomatic/consular authority.

Registration in Italy of a Marriage Celebrated Abroad by Italian Citizens

In order for a marriage celebrated abroad to have legal validity in Italy, it must be registered with the competent Italian municipality.

After the marriage has been celebrated before Vietnamese authorities and the Vietnamese marriage certificate has been obtained, the following documentation must be submitted to the Consular Office of the Embassy of Italy in Hanoi, by appointment only via email at consolare.hanoi@esteri.it:

  • Certified copy of the Vietnamese marriage certificate, duly legalized and translated (list of translators);
  • Application form for registration of the marriage certificate in Italy, duly completed in all its parts;
  • Photocopy of the passports of both spouses (original passports must be presented at the appointment).

Note: Registration in Italy can also be carried out by delivering the certified, legalized, and translated copy of the Vietnamese marriage certificate directly to the competent Italian municipality.

In the case of a choice of separation of property regime, the Consular Office of the Embassy of Italy in Hanoi will draft the related marital property agreement, which must be signed by both spouses in the presence of two Italian witnesses, unrelated to the parties and holding a valid passport.
The presence of both spouses is required at the appointment for the registration request.
