{"id":8226,"date":"2025-07-17T15:21:58","date_gmt":"2025-07-17T08:21:58","guid":{"rendered":"https:\/\/ambhanoi.esteri.it\/?page_id=8226"},"modified":"2026-03-23T14:04:36","modified_gmt":"2026-03-23T07:04:36","slug":"birth-registration","status":"publish","type":"page","link":"https:\/\/ambhanoi.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino-italiano\/stato-civile\/birth-registration\/","title":{"rendered":"Birth Registration"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>Law No. 74\/2025<\/strong>, converting <strong>Decree-Law No. 36 of 28\/03\/2025<\/strong>, introduced a new regulation on the transmission of Italian citizenship, amending <strong>Law No. 91 of 05\/02\/1992<\/strong>.<\/p>\n<p style=\"text-align: justify;\">To register the birth certificate in Italy of a minor born abroad as an Italian citizen, it is necessary to distinguish between two separate applicant categories.<\/p>\n<p style=\"text-align: justify;\"><strong>CATEGORY 1: CITIZENSHIP FROM BIRTH<\/strong><\/p>\n<p style=\"text-align: justify;\">The following cases fall under this category:<\/p>\n<p><strong>a)<\/strong> Minor children born abroad holding <strong>Italian citizenship only<\/strong>.<\/p>\n<p style=\"text-align: justify;\">In this category are excluded minors whose parent is Vietnamese, as Vietnam grants citizenship <em>jure sanguinis<\/em>, unless both parents explicitly <strong>renounce<\/strong> the child\u2019s Vietnamese citizenship when the birth certificate is issued by Vietnamese authorities.<\/p>\n<p><strong>b)<\/strong> Minor children of a parent (including adoptive parent) or grandparent who <strong>holds &#8211; or held <\/strong>at the time of death &#8211; <strong>only Italian citizenship<\/strong>. (Article 3-bis, paragraph 1, letter c), Law of February 5, 1992, No. 91).<\/p>\n<p><strong>c)<\/strong> Minor children of a parent (including adoptive) with Italian citizenship who was <strong>resident in Italy for at least two continuous years<\/strong> before the child\u2019s birth or adoption. (Article 3-bis, paragraph 1, letter d), Law No. 91\/1992).<\/p>\n<p style=\"text-align: justify;\">If the minor falls into any of the above cases (a, b, or c), their <strong>birth certificate may be registered in Italy<\/strong> while the child is still a minor, by submitting the required documents to the Consular Office of the <strong>Italian Embassy in Hanoi<\/strong>, <strong>after booking an appointment<\/strong> by email: consolare.hanoi@esteri.it.<\/p>\n<p style=\"text-align: justify;\">\u27a1\ufe0f <strong>In these cases, registration is free of charge.<\/strong><\/p>\n<p style=\"text-align: justify;\">\u27a1\ufe0f <strong>In these cases<\/strong>, the minor child is recognized as an Italian citizen <strong>from birth<\/strong>.<\/p>\n<p style=\"text-align: justify;\"><strong>REQUIRED DOCUMENTS FOR BIRTH REGISTRATION (ALL CASES):<\/strong><\/p>\n<p style=\"text-align: justify;\">The following documents must be submitted to the Consular Office:<\/p>\n<ul style=\"text-align: justify;\">\n<li>A <strong>certified copy of the Vietnamese birth certificate<\/strong>, legalized and translated by appointed translators of the Embassy (translators list available on the Embassy website);<\/li>\n<li>A <strong>birth registration request form<\/strong>;<\/li>\n<li>Photocopies of both parents\u2019 <strong>passports<\/strong> (originals must be shown at the counter).<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><strong>Note<\/strong>: If the birth certificate is issued by a country other than Vietnam, the applicant must ensure the document is <strong>legalized (or apostilled)<\/strong> and translated into Italian, through the competent <strong>Italian Embassy or Consulate<\/strong> in that country.<\/p>\n<p style=\"text-align: justify;\"><strong>Important Additional Conditions:<\/strong><\/p>\n<ul style=\"text-align: justify;\">\n<li>If the <strong>parents are married<\/strong>, their <strong>marriage must be registered in Italy<\/strong>.<\/li>\n<li>If not yet registered, marriage registration <strong>can be completed at the same time<\/strong> as the birth registration.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><strong>Note<\/strong>: If the marriage certificate was issued by a country other than Vietnam, the applicant must have it legalized\/apostilled and translated via the appropriate Italian consular authority.<\/p>\n<p style=\"text-align: justify;\"><strong>Without marriage registration<\/strong>, the birth certificate <strong>cannot<\/strong> be registered.<\/p>\n<ul style=\"text-align: justify;\">\n<li>If the <strong>parents are not married<\/strong>, the <strong>Italian parent must first formally acknowledge<\/strong> the child before the Consular Office in Hanoi. The acknowledgment document is then sent to the competent Italian Municipality along with the birth certificate for registration.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><strong>ADDITIONAL DOCUMENTS REQUIRED BY CASE:<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>CASE B) \u2013 Proof that ancestors held only Italian citizenship<\/strong><\/p>\n<p style=\"text-align: justify;\">The applicant must provide <strong>irrefutable evidence<\/strong> that the parent or grandparent <strong>did not and does not<\/strong> hold any other citizenship.<\/p>\n<p style=\"text-align: justify;\">Acceptable documents include:<\/p>\n<ul style=\"text-align: justify;\">\n<li>Negative citizenship certificates;<\/li>\n<li>Official renunciation statements;<\/li>\n<li>Certificates of non-registration on foreign electoral rolls;<\/li>\n<li>Any official document proving exclusive Italian citizenship.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Personal self-declarations are not accepted.<\/p>\n<p style=\"text-align: justify;\"><strong>CASE C) \u2013 Proof of Italian residence before birth<\/strong><\/p>\n<p style=\"text-align: justify;\">The parent\u2019s residence must be proven by a:<\/p>\n<ul style=\"text-align: justify;\">\n<li><strong>Historical residence certificate<\/strong> issued by the relevant Italian Municipality.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Only <strong>Italian citizen parents<\/strong> are considered for this purpose (foreign parents&#8217; residence is not relevant). The <strong>residence must have been continuous for at least two years<\/strong> before the birth.<\/p>\n<p style=\"text-align: justify;\">If the Italian parent gained citizenship <strong>after<\/strong> residing in Italy, the residence period <strong>still counts<\/strong> toward this requirement.<\/p>\n<p style=\"text-align: justify;\"><strong>CATEGORY 2: CITIZENSHIP BY \u201cBENEFIT OF LAW\u201d<\/strong><\/p>\n<p style=\"text-align: justify;\">In two specific cases (Article 4, paragraph 1-bis of Law 91\/1992 and Article 1, paragraph 1-ter of Decree-Law No. 36\/2025), minor children <strong>born abroad<\/strong> to an Italian parent who does not automatically transmit citizenship may <strong>acquire Italian citizenship<\/strong>.<\/p>\n<p style=\"text-align: justify;\">In these cases, the child does <strong>not<\/strong> acquire citizenship <em>from birth<\/em>, nor <em>jure sanguinis<\/em>.<\/p>\n<p style=\"text-align: justify;\">According to <strong>Article 15 of Law 91\/1992<\/strong>, citizenship is acquired <strong>from the day after<\/strong> the legal conditions are met.<\/p>\n<p style=\"text-align: justify;\"><strong>\u27a4<\/strong><strong> FIRST CASE (Art. 4, paragraph 1-bis, Law 91\/1992)<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>Requirements (all must be met):<\/strong><\/p>\n<ul style=\"text-align: justify;\">\n<li>One of the parents is an <strong>Italian citizen by birth<\/strong><br \/>\n(Excludes those naturalized under Art. 9, those who acquired citizenship by marriage, re-acquisition, legal benefit, etc.).<\/li>\n<li>Both parents (including the foreign one), or the legal guardian, must submit a <strong>formal declaration of intent<\/strong> to acquire Italian citizenship within <strong>one year<\/strong> of:\n<ul>\n<li>the child&#8217;s birth, or<\/li>\n<li>the establishment of parentage with the Italian parent, or<\/li>\n<li>the adoption by the Italian citizen.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">If both parents are Italian citizens by birth and parentage is recognized at different times, the one-year deadline starts from the <strong>first recognition<\/strong>.<br \/>\nIf the first recognition is by a foreign parent or a non-birthright Italian citizen, the one-year deadline starts from the <strong>second parent&#8217;s<\/strong> recognition.<\/p>\n<p style=\"text-align: justify;\">This declaration must be <strong>made in person<\/strong> at the <strong>Italian Embassy in Hanoi<\/strong>.<\/p>\n<p style=\"text-align: justify;\">If parents declare separately in different dates, the law considers the declaration valid from the <strong>second parent&#8217;s<\/strong> declaration date.<br \/>\nIf the child has only one legal parent or the other is deceased, <strong>only one declaration is sufficient<\/strong>.<\/p>\n<p style=\"text-align: justify;\"><strong>\u27a4<\/strong><strong> SECOND CASE (Art. 1, paragraph 1-ter, DL 36\/2025)<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>Requirements (all must be met):<\/strong><\/p>\n<ul style=\"text-align: justify;\">\n<li>The person must be <strong>a minor on May 24, 2025<\/strong>;<\/li>\n<li>The child must be of <strong>Italian parents by birth<\/strong>, and meet the requirements set out in letters a), a-bis), and b) of Article 3-bis of Law No. 91\/1992.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">In other words, the parents must be recognized as Italian citizens on the basis of an administrative or judicial application submitted by 11:59 p.m. (Rome time) on March 27, 2025, or on the basis of an application submitted following an appointment scheduled by the Consular Office or the Municipality by the same date.<\/p>\n<p style=\"text-align: justify;\">The declaration by parents\/guardian must be submitted to the <strong>Italian Embassy in Hanoi<\/strong> by <strong>May 31, 2029<\/strong>.<br \/>\nIf the applicant becomes an adult in the meantime, they must <strong>personally submit<\/strong> the declaration by the same deadline.<\/p>\n<p style=\"text-align: justify;\"><strong>Required documents<\/strong> include:<\/p>\n<ul style=\"text-align: justify;\">\n<li>Identity documents of both applicant and child;<\/li>\n<li>Proof of residence in the consular jurisdiction;<\/li>\n<li>Any documents required by the relevant declaration form.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><strong>AIRE-registered citizens<\/strong> in the consular jurisdiction may replace the parent\u2019s Italian citizenship certificate with a <strong>self-declaration<\/strong>.<\/p>\n<p style=\"text-align: justify;\"><strong>Administrative Fee (Art. 9-bis, Law 91\/1992):<\/strong><\/p>\n<p>The new 2026 Budget Law establishes that all statements of intent to acquire Italian citizenship by \u201cbeneficio di legge\u201d submitted from 1 January 2026 are exempt from any fees.
